Fixing IEP problems at public school in Kansas

Let’s examine what parents attempt to  fix IEP problems. But is that really the issue that needs addressed? Perhaps it’s something more.

Parents can have more control

Hypothetically, let’s say a child had needs/goals that went unaddressed or misaddressed for an entire school year, and as a result, the child now struggles more and has significantly regressed because of the public school’s failures.

Parents commonly pursue resolving this dilemma by:

  1. request another IEP meeting
  2. have meetings (not IEP meetings) with administratorsphotoboybooks
  3. call or take a friend to help
  4. call a case manager from a different system to go to a meeting

Did any of these help the child recover from the regression?

Other parents commonly pursue resolving this dilemma in these ways:

  1. contact a non-profit agency who trains parents
  2. contact a non-profit whose staffer or volunteer goes to an IEP meeting (sometimes waiting for weeks to get processed in a system)

Congress has avenues in place for parents to pursue correction and regression. There are ways to press a public school to be accountable, and perhaps offer to make up for their errors.  We know the steps parents can take to pursue letting the school “make up” for their errors.

Don’t be bamboozled!  Waiting and hoping for problems to go away allows our children to regress.  Begging in the meeting usually doesn’t work.  Hoping the problem will go away will only delay getting the problem addressed.  Waiting too long to address concerns eliminates opportunities for correction. Student sent home since public school no program in Kansas

Student with behaviors that the public school doesn’t appropriately address is sent home. The parent has no idea that the school has a duty to provide programming for this student to the same extent that typical student benefit from schooling (such as a full day). IEP meetings: what parents aren’t told Kansas

IEP students who have difficulty at public school who are often sent home, sent to in-school suspension (ISS), or out-of-school suspension (OSS) may not be in the right program, yet the public school doesn’t offer a “right” program. This predicament is addressed by Congress when Congress arranged for mediation between parents and schools.  Mediation is where parents can take more control of the problems with the public school. rsz_teen-reading

Often a Kansas IEP team doesn’t or won’t think beyond the routine in their building.  Serious matters require using a different approach to achieve reasonable outcomes for a student and mediation is where this can happen; mediation participants are not the usual IEP meeting attendees.

Schools may lead parents to believe that “due process” is the only option for the parent to pursue; this is not true.  A parent is being gracious to the district when participating in mediation rather than pursuing other avenues.

Kansas special education: double-talk by school staff misleads parent

Parents now report school staff ask parents intimidating questions to redirect parents away from the topic of services that our children need. “Don’t you want your child to be independent?” is the most common question parents are asked in one district where a child has autism.

Within the last four years I have noticed that the supports (paraprofessionals) that were a given for many students with inappropriate behaviors are no longer mentioned to parents. These districts are placing the overwhelming task on a classroom teacher of up to 30 students.  Unrealistic to all!rsz_asianteenmale-vert-199x300

Uninformed and inexperienced parents don’t realize their child is missing basic supports services while at public school. This results in suspensions that are unnecessary and could usually be avoided.

IEP meetings in Kansas go nowhere for special education student

Student struggles with going to public school and doesn’t want to go anymore.  Parent requests and attends IEP meetings where solutions offered are not addressing student’s needs.  Repeated meetings do not lead to productive outcomes. rsz_meeting7

One way to avoid repeated fruitless IEP meetings is to take it out of that sphere and to a level where the players are different, the parent  has more clout, and the game is differentmediation. Congress put mediation in place for us (parents) and it’s where parents can allow the district to “make up” for the district’s past errors.  A mediator is provided free by the state.  MEDIATION IS NOT LIKE AN IEP MEETING!

Parents who had more than one meeting over the same topics with no positive results can consider mediation–it’s relatively quick compared to other approaches.
